By accepting the terms of this Agreement, you are consenting to receive account documents electronically in Online Banking instead of receiving paper documents in the mail.
For purposes of this Agreement, the terms “we”, “us”, and “our” refer to Tri City National Bank (“Bank), and the terms “you” and “your” refer to the individual who is identified on our records as an authorized signer on an Account. “Account” means your eligible Tri City National Bank checking, savings, certificate of deposit, loan, retirement, and money market account.
You may choose to receive documents related to your Account(s) electronically instead of in paper form by affirmatively consenting to this Online Documents Agreement (“Agreement”). The documents you consent to receive electronically are collectively referred to as “Documents” and include but are not limited to the following:
By affirmatively consenting, you are requesting that Tri City National Bank provide documents to you electronically in Online Banking instead of receiving paper documents in the mail. You are also consenting to receive emails notifying you that documents are available for viewing in Online Banking.
Joint Accounts. For accounts owned jointly, any one of the joint owners may consent to receive documents electronically and that election will apply to all accountholders. The consent of all joint owners is required to withdraw consent to receive documents electronically. When you withdraw consent, you will lose access to the historical documents stored in Online Banking. We reserve the right, in our sole discretion, to discontinue providing documents electronically and send paper documents to your mailing address at any time.
To view and access the documents electronically in Online Banking, you must have access to a computer or other device that has the following hardware and software minimum requirements:
a. An up-to-date operating system capable of accessing the internet and downloading PDF files, e.g., Microsoft Windows or Mac OS;
b. An active email account;
c. Adobe Acrobat Reader (free download is available at www.adobe.com); and
d. Computer or device storage to retain the documents electronically or a printer to retain paper copies.
It is your sole responsibility to determine whether your computer or other system meets the hardware and software requirements necessary to receive documents electronically and to receive email notifications from the Bank. The Bank does not represent that your computer or other device will be compatible with or otherwise support electronic documents. It is your responsibility to print or download electronic Documents if you wish to maintain a copy for your records. The Bank will notify you if the hardware and/or software requirements needed to access or retain electronic documents changes and is no longer sufficient to access or retain the electronic documents subject to consent.
It is your responsibility to keep your email address and other contact information current and you agree to notify us of any changes.
As documents become available the Bank will send an email, to the email address on record at the Bank, notifying you of the availability of these documents in Online Banking. You should then log in to Online Banking and click on the Documents tab to view, print and/or save your documents.
If an email is returned to us as undeliverable, or you otherwise do not receive the email notification, your documents will still be available to you in Online Banking. The date on which you will be deemed to have documents available to you is the date such documents are posted in your Online Banking profile, whether or not you receive or access the above-mentioned email. You have the right at any time to withdraw your consent and to receive paper documents mailed to you.
You agree to notify us if you are not able to receive, view or print your documents, at which time we may begin mailing paper documents to the mailing address we have on record at the Bank. If you wish to contact the Bank pertaining to any issue with your electronic documents, please call Customer Support at 414.874.2489, or log in to Online Banking, click on Customer Support, and select Contact Us.
Paper copies of documents that were previously sent electronically are available upon request by calling Customer Support at 414.874.2489. There may be a fee to obtain a paper copy of a document that was previously provided electronically. Refer to the Fee Schedule for more information.
You have the right to withdraw consent and to require that we provide your documents in paper form. The Bank will continue to provide documents electronically until we receive notice of your withdrawal of consent and we then have sufficient time to act in compliance with such a request, including but not limited to making necessary changes in our systems to effect the change. The consent of all joint owners is required to withdraw consent to receive documents electronically. When you withdraw consent, you will lose access to the historical documents stored in Online Banking. To withdraw your consent:
This Agreement is intended to supplement and not to replace other agreements between you and us relating to your Account(s) including, without limitation, our Deposit Account Rules and Online Banking Disclosures. In the event of a conflict between this Agreement and any other account rules and agreements that apply to your accounts, this Agreement shall govern and prevail.
We may amend this Agreement at any time with notice from us to you, as required by law. If we have notified you of a change in any term of this Agreement, by accessing Online Documents after the amendments have been made, you agree to be bound by the amended agreement.
You agree to indemnify, defend and hold harmless Tri City National Bank officers, directors, employees, consultants, agents, service providers, and licensors against all claims, demand, proceedings, suits and actions and all liabilities, losses, expenses and costs, including attorneys’ fees and expenses, resulting from your failure to comply with the terms of this Agreement, including, without limitation, your failure to keep Tri City National Bank informed of your correct email address or resulting from your negligent or improper use of the Online Documents process.
